Welcome to Sterling Nanny. By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully.
1. Introduction
Sterling Nanny ("we," "us," or "our") provides a platform connecting families seeking childcare services with professional nannies. These Terms govern your use of our website and services.
Important: Sterling Nanny is a referral and matching service. We are not an employer of any nanny. The employment relationship exists directly between the family and the nanny.
2. Definitions
- "Family" means any individual or household seeking childcare services through our platform.
- "Nanny" means any individual seeking childcare employment through our platform.
- "Services" means the matching, verification, and support services provided by Sterling Nanny.
- "Platform" means our website and related services.
3. Eligibility
By using our services, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into binding agreements
- All information you provide is accurate and complete
- You are legally eligible to work in Kenya (for nannies)
4. Services Overview
4.1 For Families
Sterling Nanny helps families find qualified nannies through:
- Personalized matching based on your requirements
- Access to our database of vetted nannies
- Interview coordination and support
- Ongoing placement support
4.2 For Nannies
Sterling Nanny helps nannies find rewarding positions through:
- Profile creation and visibility to families
- Verification of qualifications and references
- Job matching based on your preferences
- Professional development opportunities
5. Fees and Payments
5.1 Placement Fees
Sterling Nanny charges a placement fee upon successful matching of a family with a nanny. Fee amounts will be communicated clearly before any placement is finalized.
5.2 Payment Terms
Fees are due as specified in your service agreement. Failure to pay may result in suspension of services and collection efforts.
5.3 Refund Policy
If a placement does not work out within the first 30 days, we will work with you to find a replacement at no additional cost. Refunds are handled on a case-by-case basis.
6. Verification and Background Checks
We conduct verification and background checks on nannies, including:
- Identity verification
- Reference checks
- Qualification verification
- Criminal background checks (where permitted by law)
However, we cannot guarantee the accuracy of all information or the suitability of any nanny. Families are encouraged to conduct their own interviews and due diligence.
7. Code of Conduct
All users agree to:
- Treat others with respect and professionalism
- Provide honest and accurate information
- Comply with all applicable laws
- Not engage in discriminatory or harassing behavior
- Not use the platform for any unlawful purpose
8. Intellectual Property
All content on our platform, including logos, text, graphics, and software, is the property of Sterling Nanny and is protected by copyright and other intellectual property laws. You may not use our content without our express written permission.
9. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Limitation of Liability
To the maximum extent permitted by law, Sterling Nanny shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services. Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim.
Disclaimer: Sterling Nanny is not responsible for the conduct of any family or nanny. We provide a platform for connection but do not supervise or control the employment relationship. All users assume full responsibility for their interactions and agreements.
11. Indemnification
You agree to indemnify and hold harmless Sterling Nanny, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of our services or violation of these Terms.
12. Termination of Partnership
We may terminate or suspend our working relationship with you immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
13. Governing Law
These Terms shall be governed by the laws of Kenya. Any disputes arising under these Terms shall be resolved in the courts of Nairobi, Kenya.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through our platform. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.
